CRA LEGISLATIVE ACTIVITIES

More than 200 bills have already been introduced in the first three weeks of the 2018 Colorado Legislature Session and so far we are monitoring 30 which may have an impact on the restaurant industry. Last week you heard about transfer of alcohol upon closing, and ADA right to cure. This week we highlight a couple more issues:

House Bill 1001 would create a Family and Medical Leave wage replacement program for employees who encounter a Family and Medical Leave event. This would be funded by every employee in the State of Colorado paying .99% of their annual income into a state fund. Additionally, the Department would have the authority to issue a solvency surcharge that would be increased as needed to keep the fund solvent. The CRA is opposed to this legislation because it has some serious flaws in how the program is created and funded, with the current proposed structure making it impossible to stay solvent.

House Bill 1043 would require all retailers of beef in the State of Colorado to display a sign near where the beef is being sold identifying the country of origin of the beef. The CRA is opposed to this legislation because it is another unnecessary requirement on Colorado’s restaurants and would mean that every table in a restaurant would have to have a sign on it identifying the country of origin of the beef the sell.

Senate Bill 067 would create the ability for restaurants and bars to host non-profit events which have a silent auction that includes sealed bottles of alcohol. Current practice is that many establishments host non-profit events with alcohol as auction items. However, even though it has not been enforced in the past this is against current Colorado liquor law as it allows alcohol to leave a licensed premises. This bill will clean up the discrepancy between actual practice and state statute. The CRA supports this legislation and will help to ensure its passage.

OSHA INJURY DATA - Our partners at Pinnacol point out that there are new requirements for submitting OSHA injury data. While these do not apply to restaurants, they do apply to caterers. Read more about these requirements on our blog here.
