Tip Pooling Notification
When it comes to the required notification that notifies customers that you run a tip pool, that notification MUST be on a menu, table tent, or receipt.
Service Charge Notification
For service charge required notification, the only location requirement is that it be “conspicuous”. You may have a sign at the entrance as long as it is the only entrance and every customer must go through that entrance, and the sign is not blocked, then yes, that would be a conspicuous location. If you have more than one entrance, post a sign at each one.
If you do online sales, then the notification would also have to be posted online where customers are going to see it, during the ordering process.
Note: The Colorado Attorney General’s office has rulemaking authority on this requirement and while we expect them to release rules and further guidance, they have not done so as of August 2026. Guidance relating to the service charge notification may change in the future, and we will send the update through the Hospitality News e-newsletter.
