Sales tax grace period, Legislative Reception, CRA Annual Membership Meeting, and more!

Last week, the Colorado Department of Revenue (DOR) announced that they are extending the automatic grace period for the new sales tax collection rules until May 31, 2019. At a hearing held in November, many Colorado small businesses and groups like the CRA testified to the difficulties of complying with the proposed sales tax rules that were to go into effect the following day. Many business owners and trade associations asked the DOR to delay enforcement of the proposed rules to give time for the Colorado Legislature (which starts meeting on January 4, 2019) to come up with a legislative fix. The DOR listened and decided to extend the automatic grace period allowing for legislative action to take place before these new rules would be enforced. 

The proposed new rules on sales tax collection requires any business who is delivering product or shipping products to consumers to charge the applicable sales tax for the delivery address. This is a change from the current standard that requires businesses to collect the sales tax rate for the location of the business. In Colorado, there are more than 600 taxing jurisdictions and restaurants would have to look up the address of every single delivery order to determine the appropriate sales tax rate, which can change block by block in some cases. Additionally, if the restaurant does deliver to multiple jurisdictions, they would now be required to file sales tax returns for any city they delivered to if that city’s sales taxes aren’t collected by the state. Finally, the proposed rules also didn’t provide any guidance on how this would impact the use of third party delivery services. 

We worked with the Simplify CO Sales & Use Tax Coalition on this rule and will continue to work with them on any proposed legislative solutions. Please look for more information from us on this subject as things develop.
