Legislative Update – Ban the Box Update

This week, a bill on the timing of an inquiry into a job applicant’s criminal history passed out of the House Judiciary Committee in Colorado. House Bill 1025 is one of the most moderate versions of this legislation that has been introduced in the country and significantly pared down compared to previous versions that have been introduced in Colorado. This bill, if passed, would do two things. First, it would not allow an employer to state on a job posting that persons with a criminal history may not apply for the position. Second, it would not allow an employer to require disclosure of criminal history on an application form.

Because of the hard work the business community, including the CRA, has done with the sponsors over the last several years, this bill still allows an employer to perform a background check on job candidates at any point in the hiring process, still allows an employer to ask (just not on the initial application form) about a job applicants criminal history, and the sponsors have removed the private right of action that has existed in previous versions of this legislation. Because the sponsors have taken into account the concerns of the CRA and other business groups, the CRA is currently neutral on the bill and will monitor it closely as it moves through the legislative process.
